Welcome to Toypool! These Terms and Conditions (“Terms”) govern your access to and use of the Toypool platform, including our website toypool.in, toy rental services, subscriptions, purchases, and all related services (collectively, the “Platform”). Please read these Terms carefully before using our services.
By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy. If you do not agree to these Terms, please do not access or use the Platform.
These Terms apply to all visitors, registered users, and customers of Toypool.
1. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or legal proceedings arising out of or in connection with the use of the Platform, toy rentals, purchases, or any services provided by Toypool shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

2. Eligibility
To use the Toypool Platform, you must:
- Be at least 18 years of age, or be using the Platform under the supervision of a parent or legal guardian
- Be legally competent to enter into a binding agreement under applicable Indian law
- Not be barred or restricted from using the Platform under any applicable law or prior Toypool decision
3. Account Registration & User Responsibilities
To access certain features of the Platform, you will need to create a Toypool account. You agree to:
- Provide accurate, complete, and up-to-date information during registration
- Maintain the confidentiality of your account login credentials
- Take full responsibility for all activities that occur under your account
- Maintain only one active account unless specifically permitted by Toypool
- Ensure your contact details, delivery address, and payment information remain current
- Use the Platform only for lawful, personal, non-commercial purposes
4. Communication Consent
By creating an account on Toypool, you consent to receiving communications from us through the following channels:
- Phone calls and SMS
- WhatsApp messages
- Email notifications
- Push notifications (if applicable)
You may opt out of promotional communications at any time by contacting us at support@toypool.in. Please note that transactional and operational messages, such as order updates and delivery coordination, will continue to be sent regardless of your promotional preferences.
5. Toy Rental, Orders & Availability
All toy rentals and orders placed on the Platform are subject to availability at the time of booking. Toypool does not guarantee the availability of any specific toy, brand, or category at any given time.
Estimated delivery timelines are indicative only and may vary due to:
- Inventory availability and ongoing rentals
- Your delivery location and logistics routes
- Public holidays and peak demand periods
- Unforeseen operational or supply chain constraints
- Weather conditions or natural events
6. Delivery, Pickup & Serviceability
Toypool currently operates in designated serviceable areas within Bengaluru, Karnataka. Availability of services in your specific location will be confirmed at checkout.
As a user, you are responsible for:
- Providing a complete and accurate delivery address
- Ensuring someone is available to receive the delivery during the communicated window
- Coordinating pickup of rented toys within the agreed return timeline
- Cooperating with any verification requirements at the time of delivery or pickup
7. Toy Usage, Hygiene & Safety
Toypool follows a thorough cleaning, sanitisation, quality inspection, and safety-check process for every toy before dispatch. We take the safety of your child seriously.
However, please note the following:
- Parents and guardians are fully responsible for supervising children during toy usage at all times
- Users are responsible for ensuring age-appropriate use of all toys as indicated on each product
- Toypool shall not be held liable for any injuries, allergic reactions, choking hazards, accidents, or losses arising from improper use, lack of supervision, or misuse of toys
- Upon receiving a toy, please inspect it immediately and report any concerns or damage to us within 24 hours of delivery at support@toypool.in
If you notice any defect, missing part, or hygiene concern upon delivery, please do not use the toy and contact us immediately. We will arrange a prompt replacement.
8. Product Condition, Damage & Loss Policy
You are expected to handle all rented toys with reasonable care throughout the rental period. Normal wear and tear from appropriate use is accepted and expected.
However, users will be held responsible and may be charged for:
- Significant damage beyond normal wear and tear
- Missing parts, accessories, or packaging
- Loss or theft of a rented toy
- Damage caused by misuse, negligence, or improper storage
- Additional daily rental charges
- Membership suspension or cancellation
- Recovery proceedings and legal action where necessary
9. Pricing & Payments
All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Toypool reserves the right to revise pricing at any time without prior notice.
Payments must be made in full at the time of placing an order or activating a subscription. We accept payments through authorised payment gateways integrated into the Platform, including UPI, credit/debit cards, and net banking.
- Toypool does not store your full card details on our servers
- All payment transactions are processed securely through third-party payment providers
- You must use only payment methods that are lawfully owned by or available to you
10. Refunds & Cancellations
Toypool aims to provide a seamless experience for all users. Our refund and cancellation policy is as follows:
Cancellations
- Orders cancelled before dispatch will be eligible for a full refund
- Orders cancelled after dispatch but before delivery may be subject to logistics charges
- Once a toy has been delivered and accepted, cancellations will not be entertained
Refunds
- Approved refunds will be processed within 7–15 business days to the original payment method
- Toypool reserves the right to deny refunds in cases involving policy violations, fraudulent activity, or misuse of the Platform
- Refund eligibility for subscription or membership fees will be assessed based on usage history and the terms of the specific plan

11. User Conduct & Prohibited Activities
You agree to use the Toypool Platform responsibly and in compliance with all applicable laws. The following activities are strictly prohibited:
- Using the Platform for any unlawful, fraudulent, or harmful purpose
- Creating multiple or fake accounts to exploit offers or rental policies
- Reselling, subletting, or commercially exploiting rented toys
- Sharing account credentials with unauthorised persons
- Attempting to gain unauthorised access to any part of the Platform or its systems
- Interfering with or disrupting the operation of the Platform
- Using abusive, threatening, or offensive language toward Toypool staff, delivery personnel, or other users
- Providing false information during registration, checkout, or support interactions
12. Intellectual Property Rights
All content available on the Toypool Platform, including but not limited to logos, brand identity, product images, toy catalogue, website design, graphics, text, software, and videos, is the exclusive intellectual property of Toypool or its licensors and is protected under applicable Indian intellectual property laws.
You may not, without prior written consent from Toypool:
- Copy, reproduce, or redistribute any Platform content
- Use Toypool’s brand name, logo, or trademarks for any commercial purpose
- Modify, publish, or create derivative works from any Platform content
- Scrape or data-mine any part of the Platform
13. Third-Party Services
The Platform may integrate with or link to third-party service providers such as payment gateways, logistics partners, analytics tools, and communication platforms. Toypool shall not be responsible for:
- Interruptions, failures, or errors caused by third-party systems
- Payment gateway outages or delayed bank settlements
- Data breaches or service disruptions caused by third-party providers
14. Privacy & Data Usage
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, storage, and use of your information as described in the Privacy Policy.
Toypool may use aggregated and anonymised data for analytics, platform improvement, and business intelligence purposes, without identifying you as an individual.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Toypool shall not be liable for:
- Any indirect, incidental, special, or consequential loss or damage
- Delays in delivery or pickup due to logistics, weather, or operational constraints
- Temporary unavailability of specific toys or services
- Injuries, allergic reactions, or accidents arising from toy misuse or inadequate supervision
- Technical outages, app errors, or platform downtime
- Losses arising from third-party service failures
- Any developmental outcomes or educational results expected from toy usage
16. Indemnification
You agree to indemnify, defend, and hold harmless Toypool, its founders, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, costs, or legal expenses (including reasonable attorneys’ fees) arising from:
- Your violation of these Terms or applicable law
- Misuse or negligent handling of rented toys
- Any fraudulent activity carried out through your account
- Injury or damage caused during the use of toys under your supervision
- Any content or information you submit to the Platform
17. Suspension & Termination
Toypool reserves the right to suspend, restrict, or permanently terminate your account and access to the Platform, without prior notice, in cases including but not limited to:
- Non-payment of dues or outstanding rental charges
- Violation of these Terms or any Platform policies
- Fraudulent, abusive, or suspicious account activity
- Failure to return rented toys within the agreed period
- Threatening or offensive behaviour toward Toypool personnel or other users
18. Force Majeure
Toypool shall not be held liable for any delay, failure, or interruption of services caused by circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, floods, earthquakes, or other acts of God
- Government-imposed restrictions, lockdowns, or regulatory actions
- Pandemics or public health emergencies
- Strikes, labour disputes, or supply chain disruptions
- Internet outages or power failures
- Transportation or logistics disruptions
- Acts of war, terrorism, or civil unrest
19. Modifications to Terms
Toypool reserves the right to update, modify, or revise these Terms and Conditions at any time. Any changes will be published on the Platform with a revised effective date. Your continued use of the Platform after the publication of updated Terms constitutes your acceptance of the revised Terms.

20. Severability
If any provision of these Terms is found by a competent court to be invalid, unlawful, void, or unenforceable under applicable law, such provision shall be deemed severed from these Terms. All remaining provisions shall continue in full force and effect and shall not be affected by the severance.
21. Entire Agreement
These Terms and Conditions, together with the Toypool Privacy Policy and any other applicable policies published on the Platform, constitute the complete and entire agreement between you and Toypool with respect to your use of the Platform and services. These Terms supersede all prior agreements, representations, or understandings between you and Toypool on the same subject matter.
